Terms of Service

By accessing and using the Bharat Load platform (website and mobile applications), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of Bharat Load's services, including our website, mobile applications, and any related services (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited by law from using our Services
• All information you provide is accurate and current
• You will maintain the accuracy of such information

For business accounts, you represent that you have the authority to bind the entity to these Terms.

To access certain features of the Services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

You are responsible for safeguarding your account password and must not share it with third parties. Bharat Load cannot and will not be liable for any loss or damage arising from your failure to maintain account security.

Shippers: Users who post cargo shipment requests must:
• Provide accurate cargo details (weight, dimensions, material type)
• Ensure cargo is properly packed and ready for transport
• Be present or designate an authorized representative for pickup
• Make timely payments as agreed
• Not post illegal, hazardous, or prohibited materials without proper documentation

Truckers: Fleet owners and transporters must:
• Provide accurate vehicle and business information
• Ensure vehicles meet safety and legal standards
• Assign qualified, licensed drivers
• Maintain valid insurance and permits
• Honor accepted load commitments

Drivers: Vehicle operators must:
• Possess a valid driver's license
• Follow traffic laws and safety regulations
• Provide real-time trip updates and GPS tracking
• Handle cargo with care
• Complete trips as assigned

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Post false, misleading, or fraudulent information
• Manipulate pricing or ratings
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Use automated scripts or bots without authorization
• Reverse engineer or copy any part of the Services
• Use the Services for any commercial purpose not intended by Bharat Load

Pricing: Prices are determined through negotiation between shippers and truckers. Bharat Load provides pricing recommendations but does not set mandatory prices.

Platform Fee: Bharat Load charges a platform fee (also called token money) per booking. It is payable by the shipper and the trucker at the moment an offer is accepted, at the rate published in the app at that time. Drivers pay no platform fee. The platform fee confirms the booking and unlocks the other party's contact details.

Freight Settlement: The agreed freight is settled directly between the shipper and the trucker, outside the platform, on the terms they agree. Bharat Load does not collect, hold, or guarantee freight payments. The trucker records receipt of freight in the app.

Payment Processing: The platform fee is processed through secure payment gateways.

Refunds: If a booking is cancelled after the platform fee has been paid, the side that cancels forfeits its fee and the side that did not cancel is refunded, except where Bharat Load has set platform fees as non-refundable for cancelling a confirmed booking (see section 7). On successful trip completion the fee is retained by Bharat Load. See our Refund Policy for details.

Cancellations: A booking can be cancelled in the app until the trip starts. The cancelling side's platform fee is retained by Bharat Load. If one side backs out while the platform fees are still being paid, the other side is always refunded their platform fee in full. Once the booking is confirmed, the side that did not cancel is refunded their platform fee in full unless Bharat Load has set platform fees as non-refundable for cancellations; the app's cancellation screen states which applies before a cancellation is confirmed. Disputes: In case of disputes between users, Bharat Load may assist in mediation but is not responsible for resolving disputes. You agree to first attempt to resolve disputes directly with the other party. If unresolved, you may contact our support team for assistance.

Arbitration: Any legal disputes will be resolved through binding arbitration in accordance with Indian law, rather than in court.

Insurance: Bharat Load does not provide cargo insurance. Truckers are required to maintain valid vehicle insurance and permits (see Section 4). Shippers who want cargo insurance must arrange it independently.

Limitation of Liability: Bharat Load acts as a technology platform connecting shippers and truckers. We are not a transportation provider. To the maximum extent permitted by law:

• We are not liable for damage, loss, or delay of cargo
• We are not responsible for the actions or omissions of users
• Our total liability shall not exceed the platform fee paid on the relevant booking
• We are not liable for indirect, incidental, or consequential damages

You acknowledge that transportation services are provided by independent third parties, and Bharat Load is not responsible for their actions.

The Services and their entire contents, features, and functionality are owned by Bharat Load and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. You may not:

• Reproduce, distribute, or create derivative works from our content
• Use our trademarks without prior written consent
• Remove copyright or proprietary notices
• Access or use the Services for competitive purposes

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Services, you consent to our data practices as described in the Privacy Policy.

We may use your data to:
• Provide and improve the Services
• Process transactions and send notifications
• Comply with legal obligations
• Prevent fraud and ensure platform security

We will never sell your personal data to third parties.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Violations of our community guidelines
• Requests by law enforcement or government agencies
• Prolonged inactivity

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

• Posting the updated Terms on our website
• Sending email notifications to registered users
• Displaying in-app notifications

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India.
